Can the criminal history information be made available to other employees of the provider?
No. Criminal history information (meaning information regarding pending criminal charges and criminal convictions which are not vacated or reversed) that is shared with providers by BCHI is considered confidential information. Therefore, it must be maintained in a manner that ensures the security of the information. Only the designated Authorized Persons can review the applicants criminal history information. It is permissible for the Authorized Person to disclose criminal history information to other parties who are directly participating in any employment decision with regard to the applicant and to whom the information is relevant.
