Can the obligation to provide a copy be waived?
Answer The obligation to provide a copy may be waived where the patient agrees otherwise or it is not possible to supply a copy of the material sought, or to do so would involve disproportionate effort (for example because papers have been destroyed, or are spread around the country). However, cost alone is not sufficient grounds on which to refuse to provide a copy.
