Child custody and moving out of state – NC?

I had a smiliar situation in same state. I moved from there three years ago with my 7 year old who was 4 at the time. If everything is as you’ve described then I don’t think you will have too many problems. I had a bit of a battle because we had joint custody and he would adhere to the visitation schedule at least 50% of the time. I needed to move back home because I had gotten sick and I didn’t have any family there. I was only there because I atteded college in Greensboro, the father was not from nc either, he was there for school also. I file a motion with the court and my attorney stepped in because it did get messy but in the end the judge allowed the move and all is well. Please email me as I have other information that may be useful to you. Hope all works out for you.

You do nto have sole custody of your children if he has visitation rights. You have primary custody and he has secondary. You probably have the right to make decisions on what is the best intrest of the children for say religious beliefs. But if has visitation then you dont have sole custody. I would talk with a lawyer first. There might not be a way for him to stop you but out of respect you should give him proper notice first.
