While Section 40-6-91 of Georgia Law provides that pedestrians have the right of way in crosswalks, it further states, “No pedestrian shall suddenly leave the curb or other place of safety and walk into the path of a vehicle so close that it is impractical for the driver to yield.” Section 40-6-92 provides that when crossing a street, pedestrians must use a crosswalk where one is provided. It further states that pedestrians must yield right of way to vehicles when they cross the roadway elsewhere than at a crosswalk. So, clearly, motorists and pedestrians both have rights and responsibilities when it comes to avoiding one another on the roadway.
