Yes. Restitution must be ordered by statute. However, there is often wiggle room in how the restitution is calculated and both parties can agree to an amount as part of the plea bargain. The probation officer writing the presentence report (PSR) will do an independent investigation, but particularly in white collar matters they are often overwhelmed with the paperwork and will largely rely on what the government and defendant provide them. Garnishment must be ordered by a court, but it can be ordered by the court sentencing you in the criminal matter. Your attorney should be able to review this in detail with you based on the facts of your case. If you do not have an attorney, you should choose someone familiar with the federal court system (such as a former federal prosecutor).
