~The reason that you are having difficulty finding authority in the U.S. Constitution for the Emancipation Proclamation is quite simple. There is none. Article I Section 2 and Article IV Section 2 of the Constitution make it abundantly clear that slavery was a constitutionally protected property right which could not be abridged by the federal government. The Constitution also prohibits the taking of private property (i.e., the slaves) without due process of law and just compensation. Lincoln recognized this and admitted it repeatedly throughout the 1860 Presidential campaign. Congress passed the Second Confiscation Act in July 1862. It too was an unconstitutional taking of private property. However, that act did the same thing that Lincoln purported to do several months before Lincoln did it. Lincoln claimed he had the power to ignore the Constitution under the “War Powers Clause”. Who was going to challenge him? Since the Proclamation and the Second Confiscation Act only freed slaves
