How do I make a motion in the Appellate Division Third Department?
Motions in the Third Department are returnable on a Monday. Oppositions are due by 11:00 a.m. on the Friday before the return date. The notice of motion, affidavit in support, and proof of service of (1) copy are to be filed with the clerks office. All motions should have the notice of appeal and order appealed from exhibited to it. The fee for filing a motion in this Court is $45.00.
