If a student currently attends a Program Improvement school via the VEEP, Magnet or Choice programs, can the student apply for transfer to another school under NCLB?
The status of the student’s school of residence determines whether the student is eligible to apply for NCLB-mandated school choice. If the student’s school of residence is a Program Improvement school, parents may request a transfer to a non-Program Improvement school designated by the district. If the school of residence is not a Program Improvement school, the school of residence will serve as the non-Program Improvement school option for that student under federal law. It may be unlikely at any rate that parents and students who have selected a school via one of the programs listed will want to transfer out of that school.
