This rare situation can only happen at Buda (or Edinburgh if the Scots have been reinforced beyond their starting setup). Treat it as if the army leader has been eliminated in an assault on an independent key. According to Step 11 of the Assault procedure, the leader is placed in the nearest fortified space or his capital. Independents and inactive minor powers may never capture a leader. 15.
