May private companies provide benefits to same-sex couples?

Yes. Nothing prevents or affects the validity of private agreements that are otherwise valid under Ohio law. The law does say that it is against public policy for the General Assembly and various state agencies and institutions to extend benefits of a legal marriage to same-sex couples or unmarried heterosexual couples. This prohibition does not, however, include either the private sector or political subdivisions.
