Not all investors are obligated to take action in connection with the template demand letter posted by the Receiver. As addressed in the Receiver’s recently filed Fourth Interim Report, certain investors received payments in excess of their aggregate investments, which payments may be subject to disgorgement. Specific demand letters are being sent to select investors by the Receiver’s attorneys, and recipients of these, specific demand letters are encouraged to contact the Receiver as quickly as possible to discuss the contents of the letters. If you do not receive such a letter, you need not respond to the template demand letter posted to the Receiver’s website. Of course, all investors are encouraged to maintain records of their transactions with the receivership entities.
