To what remedy is a successful contestant entitled?
[added November 26] The determination of the appropriate remedy is committed to the discretion of the court. The Florida election contest statute authorizes the judge to “fashion such orders as he or she deems necessary . . . to prevent or correct any alleged wrong, and to provide any relief appropriate under such circumstances.” Relief could include rejection of questioned ballots or a direction to recount disputed ballots applying a particular standard.
