Please refer to Labor Legislation California Codes Labor Code Section 500-558. In order to implement an AWS for non-exempt staff employed by private sector, the employer is required to: • Provide nonexempt staff with a written proposal; • Hold a secret ballot election (a proposal to adopt an AWS will be adopted only it is approved by at least two-thirds of your affected non-exempt employees); • If the proposal is adopted, document the new work schedule; and • Notify the Division of Labor Statistics and Research within 30 days.
