What can you tell me about the court case Korematsu v. United States?
It’s critical in the history of American jurisprudence; it’s the case that established the principle that strict judicial scrutiny should be applied to classifications based on race. He actually was prosecuted because he broke curfew, not because he tried to avoid internment. He wanted to see his girlfriend and they picked him up on his way there. Such is the role of romance in history. 🙂 One of the reasons that it hasn’t been overturned is the fact that the principle of subjecting governmental racial classifications to heightened judicial scrutiny has proven to be so important in American law. Despite the fact that the internment was originally found to pass that test, the structure of the decision is so critical that I doubt it will ever be overturned.
