What determines the extent of the employers obligations to a dismissed employee?
The extent of an employer’s obligations to a dismissed employee will be determined by the reason for the employer’s decision to terminate the employment contract: has the action been taken notwithstanding the employee’s compliance with the agreement, e.g., layoff because of general economic conditions (termination without cause), or has the contract been ended because the employee fundamentally breached the agreement, e.g., theft or other blameworthy conduct (termination for cause).
