What Does a Restraining Order Do?
Protective orders and peace orders can have real effects. The alleged abuser may be ordered by the court to stay away from the accuser’s home, workplace or school, and to have no contact with the accuser or individuals, such as children, included in the order. An alleged abuser also may lose the right to carry a gun, even if the weapon is required for his or her employment. Peace and protective orders must be obtained from a district court. It is possible to obtain an emergency or interim order when the court is closed. Temporary orders issued by a judge usually apply for seven days. A final protective order may remain in effect up to one year, while a final peace order may last up to six months.
