What factors will the Tribunal consider when deciding whether to order a party to produce information?
The Tribunal must be satisfied that providing the information requested will not present any risk to national security or a persons safety or affect the validity of a test. The Tribunal will also consider whether the request for information is clear enough to leave no doubt as to what information is being requested. In addition, the Tribunal must be satisfied that disclosure of the information will not cause undue prejudice to any of the parties.
