What is a criminal history record check?
A criminal history record check is a request for information regarding pending criminal charges and criminal convictions which are not vacated or reversed, with respect to a person who is applying for a position where the applicant will have regular and substantial unsupervised or unrestricted physical contact with clients with a provider of mental health services. Providers of mental health services that are licensed or approved by OMH make requests for criminal history record checks through OMH, who in turn makes a request to the Division of Criminal Justice Services (DCJS) and the Federal Bureau of Investigation (FBI). The request is made by submitting fingerprints to DCJS and the FBI through the OMH process. When the results are returned to OMH, OMH then makes a determination as to whether or not the persons application can be considered by the provider for the position sought, after applying statutory criteria to the information received.
