WHAT IS COLLATERAL AND WHEN IS IT REQUIRED?
“COLLATERAL” of some kind is always required. It can be as simple as a signature on an indemnity agreement and promissory note pledging your assets in the full amount of the bond: or, it may be a mortgage note on a parcel of real property. Many factors play into the type of collateral that is needed and you can discuss this with your bail agent. HELP IN CHOOSING A PRIVATE ATTORNEY AFTER AN ARREST, in most cases, a Judge at First Appearance or at Arraignment will ask if you need attorney representation. If you ask to be represented by a public Defender and you are deemed indigent by the court, an attorney will be provided for you. Often, however, a defendant feels it is in his/her best interest to hire a private attorney. Certainly, asking friends or family for a recommendation is good, or you may refer to your local phone directory yellow pages under “Attorneys-Criminal Law”. Most attorneys will talk to you and discuss your arrest at no charge during your initial meeting.
