This is not an easy question to answer. Very simply, though, non-marital property is property that you had prior to the marriage, that you inherited during the marriage or that you got as a gift during the marriage. In order for this property to retain its non-marital status is must not have been put in joint title with the other spouse. Also this property generally must not have been comingled with marital property as that may cause it to lose its non-marital status. Once an asset is determined to be non-marital property it is assigned to the party who originally owned it and the other spouse has no claim upon it.
