What is the mediators role?

As your mediators, we will guide you through the issues in a sequence that promotes thoughtful decision making, facilitate your communications with each other, and document your decisions. We will be neutral and unbiased. We will not make decisions for you or act as a judge. We believe you can make the best decisions for yourselves, and we can help you reach that point. donnaAs mediators, we have been through this process hundreds of times. We know the issues to be addressed and appreciate the emotional turmoil that is involved. We can visualize the end of the process even when participants are having a hard time seeing the next step. Part of our role is to provide information and suggest options to consider. Often we can tell you common ways other people have handled similar situations, so you don’t have to reinvent the wheel. We can help you explore creative solutions when you want to go in new directions.

The mediator’s role is to facilitate communication between the parties, not to impose solutions. Mediators do not advise, take sides or render a judgment. Instead, the mediator will work with all the parties to help them reach a mutually acceptable resolution.

A mediator facilitates discussion of issues but does not make decisions or recommendations. In divorce mediation, the mediator will have a general understanding of the history and breakdown of the marriage but will not address questions of fault. Although the mediator has an obligation to insure that a fair decision making process takes place, the mediator cannot insure that the terms of an agreement are fair. The mediator should terminate mediation if the parties cannot have a reasonably balanced discussion for any reason. The mediator will focus discussion on planning for the future and will try to identify common interests of the parties. With the mediator parents discuss various options and decide what plans will be best for their children and for them as parents.

The mediator’s role is to serve as a neutral person to help the communication process between the parties flow. By using dispute resolution techniques, the mediator will assist in helping to reach a custody and placement agreement that would be in their child’s best interest. The mediator does not advocate for either party. To incorporate both parents in discussing and resolving issues, the mediator does not want to have any information presented prior to the first session, other than if there is a restraining order or a safety concern. Note: If there is a restraining order or safety concerns, please contact the mediator prior to the first session. What is the Cost of Mediation? Pursuant to Wisconsin Statute, the first mediation is at no charge to the parties. Any additional mediation sessions will be a $50.00 charge to be split between the parties. This fee is not to exceed $200.00. How Long Will the Mediation Session Be? Each mediation session is scheduled for 1-1/2 hours. Mediation
