What is the principle of discretion under the Act?
The exercise of discretion is a fundamental principle underlying the FOIP Act. It is based on the notion that the public has a right of access to information in the custody or under the control of the Calgary Board of Education unless there is harm in releasing it. The discretionary exception requires the Calgary Board of Education to determine whether harm is likely to result from the release of information that falls within the exception. If no harm is apparent, the principle and spirit of the Act dictate that the Calgary Board of Education should release the information.
