What is the punishment for a DUI conviction?
If you are convicted of the offense of DUI, you can be fined up to $2,500.00 and you can receive a jail sentence of up to 364 days in the County Jail. For first time offenders, a sentencing alternative called Court Supervision is available. Court supervision is not unlike a probationary period of from one to two years pursuant to a technical plea of guilty. During that period, you must undergo a course of alcohol counseling, pursuant to an alcohol evaluation (usually 10 hours for first time offenders) and pay a court fine and costs and you must also not receive new offenses. Then at the end of the supervision period, if you have successfully completed the terms of court supervision, your DUI case is dismissed. For second offenders, penalties are more severe, and court supervision is not available. Second time offenders face the possibility of jail time and the revocation of their driving privileges if convicted.
