A custodial sentence is theoretically possible but very unlikely – if she has repaid the money then this will go well with the court but if her circumstances are such that she isn’t able to do this then the court will take that into account – your girlfriend will certainly face a civil recovery action from her former employer and she’ll have to pay it back then, probably in instalments if she can’t make a full payment. Good on you for standing by her – she made a stupid mistake that she’ll never make again and hopefully she’ll learn from her experience.
