Once a DIB is established, both parties are asked to provide written submissions, followed by meetings with the DIB. This process allows the DIB to receive and review all of the evidence for both party’s last tabled positions. Over the course of its review, the DIB may pose questions for clarification to ensure it understands the positions of both sides. Once the DIB is satisfied they have all of the facts before them, it will write a recommendation within the noted timeframe. What about strike/lock out in a DIB scenario? As outlined in the Labour Relations Code, when a DIB is put into place prior to a strike or lockout, no strike or lock out can commence. In this case, the strike has already commenced, therefore, the strike will continue unless the union agrees to lift it and participate in the DIB per Iris Evans’ condition.
