Misdemeanor IST defendants are usually placed in local mental health treatment facilities. They cannot be committed to state hospitals unless there are no less restrictive placements available, and a contract for state hospital treatment exists between the county and the Department of Mental Health. Penal Code § 1370.01 (a)(2)(A). Misdemeanor IST defendants may also be placed directly in the Conditional Release Program (CONREP) for outpatient treatment. Penal Code § 1601(b).
