Can we charge a higher rate for overtime and weekend work? If the personnel proposed are “salaried – exempt” the answer is No. If the personnel proposed are “non-exempt hourly” the answer is yes for anything over 40 hours in a contiguous week, but ICF will not pay overtime just because personnel may be working on week-ends unless the federal and state of Virginia rules for overtime pay are met. Secondly, if the bidder is required by state and/or federal labor regulations to pay non-exempt personnel time and one-half we would expect to see a billing rate without a full fifty percent markup on the half-time. Subcontractors may also be subject to audits to verify compliance with the aforementioned overtime pay rules. Can the contractor bring on more people if we need additional help?
