I can quote you over 15 different passages which substantiate the fact that employers are prohibited by federal law from exerting control over the tips customers present their employees. But why is the DOL allowing business owners to mandate that all tips will be controlled by the employer? That’s what employer mandated tip pooling is, employers controlling the tips customers present their workers. The DOL has issued a fact sheet which states that the law forbids any arrangement between the employer and the tipped employee whereby any part of the tip received becomes the property of the employer. A tip is the sole property of the tipped employee. Federal laws and regulations totally support what is stated.
