Can an employer appoint someone while they are waiting for confirmation of their ISA registration?

No. Employers must not appoint anyone in a regulated activity, even in a supervised capacity, until their registration is confirmed. Individuals may however, be taken on in a non-regulated capacity (i.e. to begin training) prior to registration with the ISA but it will be illegal to allow them to take up any form of regulated activity. Organisations will be given up to five years to ensure that all existing employees and volunteers undertaking regulated and controlled activities are registered with the ISA. Once registered, an employer may ask the individual’s permission to check their ISA registration status on-line; this check will be free of charge and confirmation of their registration status is immediate.
